MUNCIE, Ind. — An Indiana man is behind bars after his 3-year-old daughter reportedly got into his old pill crusher and ingested fentanyl. Despite being called by DCS over 15 times, court documents show the father never went to the hospital to see his daughter.

Devin D’rell Rollins, 25, was arrested Wednesday morning by Muncie police and charged with felony neglect of a dependent. Court records show Rollins has two previous neglect charges and three active warrants. His most recent charge stems from an incident where his child tested positive for drugs.

Court records show that on June 30, Rollins’ 3-year-old daughter was taken to IU Ball Memorial Hospital after she allegedly swallowed Tylenol while she and her dad were staying at his aunt’s house.

The aunt then called 911 and reported the child seemed lethargic. The child’s mother later told police that Rollins said he had woken up next to their daughter and that she was limp.

EMS crews arrived and took the 3-year-old to IUBMH for a checkup with Rollins allegedly in tow. DCS was also contacted and soon arrived at the hospital, but could not find Rollins.

DCS then made 19 attempts to contact both Rollins and the child’s mother, including going to multiple addresses throughout Muncie. Neither parent replied or was found.

The child’s medical records then came back with a presumptive positive test for fentanyl, police said. After this, officers found Rollins at his home on Main Street in Muncie and brought him in for questioning.

“Devin advised he just wanted to go to jail and that his daughter is fine,” a police officer wrote. “Devin stated he was withdrawing and I asked him from what. Devin stated ‘You already know from what’.”

When Rollins was told by officers that his daughter had tested positive for fentanyl, he reportedly said that she must have gotten into his old pill crusher in his backpack.

When asked why he left the house when EMS was called to help his daughter, Rollins reportedly said he knew police were coming and that he had warrants. He then said that he never even went to visit his child in the hospital, stating he knew police were looking for him and that he had been “running from these warrants” for five years.

Rollins was ultimately arrested around 3 a.m. Tuesday and booked into the Delaware County Jail on one charge of neglect of a dependent – a level 3 felony. An initial hearing has not yet been scheduled in his case.

Online court records show Rollins has at least two pending child neglect and confinement charges in Delaware County from Oct. 2023 and Jan. 2024. Both cases are pending.

NewsNation affiliate WXIN spoke with a family member who was there when the child was taken to the hospital and asked to remain anonymous. She said Rollins made the initial 911 call, and she also wanted to share this message:

“I do not excuse the choices that he [Rollins] made, however, I do feel like people should be a little more compassionate and less judgmental because I’m sure that everyone has loved ones or people they know that are addicts or in active addiction, and it’s ugly. It’s a horrible disease and it does destroy lives.”

She added that the child quickly made a full recovery and is living with another family member for now.

“She’s happy, she’s healthy, she’s loved – and he [Rollins] just made some really poor choices, and he’s going to have to live with this the rest of his life.”
