CARROLL COUNTY, Ind. — An attorney representing the defense lawyers for Delphi murders suspect Richard Allen wants to depose several people ahead of a hearing later this month.

David Hennessy, acting on behalf of attorneys Andrew Baldwin and Bradley Rozzi, subpoenaed investigators with Indiana State Police and the Carroll County Prosecutor’s Office. The depositions are scheduled for March 1, according to court documents.

Baldwin and Rozzi are representing Allen, who faces two counts of murder in connection with the February 2017 deaths of Abby Williams and Libby German near the Monon High Bridge. The Indiana Supreme Court reinstated them to the case in January after Special Judge Fran Gull advocated for their removal as Allen’s representation.

Carroll County Prosecutor Nick McLeland is now seeking both attorneys to be held in contempt of court, accusing them of mishandling of evidence and making public statements about the case as the court weighed a gag order.

According to court documents, ahead of that hearing, Hennessy wants to depose four individuals: ISP Sergeant Jerry Holeman; ISP Detective Ben Rector; Steven Mullin with the prosecutor’s office; and Mitch Westerman.

Westerman, a friend of Baldwin’s, is accused of leaking crime scene evidence last year after taking photos at Baldwin’s office and disseminating them to a source who then leaked them on social media. The revelation about the evidence leak led to a dramatic October hearing in which Gull told the court that Baldwin and Rozzi had withdrawn from the case. Westerman faces a criminal charge in connection with the leak.

The depositions would focus on the contempt of court motion filed by McLeland. The subpoena informs the individuals to bring “all notes, reports and communications, in paper or digital” regarding the “allegations of contemptuous conduct.”
