(NewsNation) — The suspect accused of killing four University of Idaho students in November 2022 is making a second attempt at getting the charges thrown out.

Bryan Kohberger, 29, is charged with four counts of murder and one count of burglary in connection with the stabbing deaths of Kaylee Goncalves, Madison Mogen, Xana Kernodle and Ethan Chapin.

Kohberger tried to get the charges thrown out before, and he’s asking again to have the indictment dismissed, claiming there was improper conduct during the grand jury proceedings.

There isn’t a lot of information on what the defense arguments will be since the judge has imposed a strict gag order on the trial. However, motions from Kohberger’s team have asked the judge to reconsider the previous motion to dismiss and filed a second motion asking for the filings to be made public.

The defense has said the grand jury did not have all the evidence in front of them and may have been biased when making their decisions.

There is also a scheduling contest planned for after the hearing, making it entirely possible that the judge will set a date for the actual trial.

The judge is not allowing media to film inside the courtroom after chastizing camera operators for focusing too much on Kohberger, zooming in and allowing the public to really pick apart how Kohberger looks in court.

On Friday, no pool camera will be allowed, and people will have to watch a livestream that comes directly from the judge’s YouTube channel.

Those inside the courtroom will also be prohibited from live tweeting, though reporters viewing the livestream will be able to post updates on social media.

The house where the killings took place was recently demolished, though the area is still surrounded by fencing. There’s also a memorial where people have dropped off candles, flowers and stuffed animals as the crime continues to weigh heavily on the town of Moscow, Idaho, and students at the university.
