(NewsNation) — Karen Read’s lawyers filed a motion Monday for the dismissal of two of the three criminal charges against her in relation to the death of boyfriend, John O’Keefe.

The first of Read’s trials ended in a mistrial last week after the jury said they were at an “impasse.”

Now, her defense has said there were “unsolicited communications” between three of the jurors and her team “indicating in no uncertain terms that the jury had a firm 12-0 agreement that Ms. Read was not guilty of two of the three charges against her, including the charge of murder in the second degree.”

The filing, according to WFXT, also stated there was a unanimous belief among the jury that Read was not guilty of leaving the scene of the fatal crash; the third count.

Read, 45, is accused of killing O’Keefe by striking him with an SUV and leaving him for dead amid a snowstorm on Jan. 29, 2022.

Prosecutors almost immediately announced their intent to retry the case, notwithstanding the defense’s assertion that Read was framed by police.
